PROTECTIVE COVENANTS

Association Members should be knowledgeable of the COVENANTS, RESTRICTIONS AND LIMITATIONS OF SHILOH FALLS SUBDIVISION.

Because Protective Covenants are sometimes confusing and complex, the Board has summarized the major restrictions that are the "most common violations" along with the referenced paragraph number for additional information. Please help us in adhering to these codes and maintaining the atmosphere of our community. These are as follows:

Business Uses (Paragraph 17)

No lot shall be used for any commercial, trade, business, mining or manufacturing purpose.

Drainage and Utility Easements (Paragraph 10, 11 & 12)

Enforcement of Rules (Paragraph 33 & 34)
The Board of Directors or the Architectural Committee has the right to enforce the performance of the covenants and restrictions and may use lawful remedies to do so. Failure to enforce any covenant or restriction does not waive the Association's right to do so thereafter.

The following procedures may be taken by the SFHA Board of Directors to enforce the rules and regulations as set forth in these guidelines:

1) All Homeowners and Property Owners shall comply with all of the provisions of the By-laws, Covenants and Rules & Regulations of the Association. Failure to comply with the aforementioned documents shall be grounds for action to recover damages or for injunctive relief, for suspension of voting rights and the use of recreational facilities, for foreclosure of liens or any other legal or equitable relief deemed appropriate.

2) In the event any rule or regulation of the Association is violated, the Member shall be notified of the violation and actions to be taken by the Association, by first class mail or by a hand delivered notice. The notice shall be delivered to the address shown on the Association's records.

3) In any instance where the violation presents a health or safety hazard, the Board of Directors may take immediate action to correct the violation. Such action shall be at the Member's expense. Notification to the Member of the action taken and the costs incurred will be by first class mail.

4) The Association, through its Board of Directors and Architectural Committee, shall have the right to enter upon any Lot at all reasonable times for the purpose of ascertaining whether such Lot and/or the construction, erection, placement, remodeling or alteration of any structure thereon is in compliance with the provisions of the guidelines.

5) The Member shall have the right to appeal any violation citation. The request for appeal is made to the Board of Directors and must be submitted in writing and received by the Board within ten (10) days of receipt of the violation notice.

6) If the decision stands, the Member is advised of the action to be taken to correct the violation, i.e. legal action, etc. The Board of Directors decision is final.

Fences (Paragraph 22)
All fences must be approved by the Architectural Committee.

Fireworks and/or Firearms (Paragraph 28)
No shooting of any fireworks or discharge of firearms shall be allowed in Shiloh Falls.

Garage Sales & Carport Sales (Amendment No. 1 to Paragraph 21)
Garage sales and carport sales are expressly prohibited.

Golf Carts (Paragraph 25)
Golf carts operated by persons eighteen years or older are permitted.

Lawn Mowing & Maintenance (Paragraph 13, 19 & 20)
Each Shiloh Falls Homeowner is responsible for maintaining the appearance of their landscaping by mowing and trimming around their homes. Lack of mowing, trimming or removal of dead brush, construction material and unused vehicles, is unreasonably detrimental to adjoining property owners and to the neighborhood. If such a situation exists, the SFHA may make arrangements, to enter upon the property and have the work completed, in which case the cost and expense of such work, including incidental expenses, filing fees, miscellaneous charges and reasonable attorneys' fees incurred by SFHA, will be added to the cost of such work.

Lease/Rental of Homes (Paragraph 17)
Any home leased may be leased only for periods in excess of six months.

Mailboxes (Paragraph 14)
All mailboxes within Shiloh Falls shall be approved by the Architectural Committee.

Motorcycles (Paragraph 25)
No motorcycles, three-wheelers, four-wheelers, all-terrain vehicles or the like shall be allowed to operate within Shiloh Falls. Golf carts are the only unlicensed motorized vehicle allowed to operate on the roads and streets within Shiloh Falls.

Nuisances (Paragraph 21)
No noxious or offensive trade or activity shall be carried on upon any lot, nor shall anything be done or permitted thereon which may be or become an annoyance or a nuisance to the neighborhood.

Parking on Shiloh Falls Streets (Paragraph 21)
Parking along the roads and streets in Shiloh Falls on a regular or habitual basis is absolutely forbidden. Vehicles parked between the street and the tree line of lots without homes, obstruct mowing of the SFHA right-of-way and may create a danger to traffic. Homeowners are required to use their garages or driveways for their vehicles at all times.

A homeowner hosting a "large group" function attended by a large number of people must advise Security of the function in advance and visitor vehicles may park on the street near the host's home during the hours of the function.
Any vehicle in violation of these parking rules shall be subject to towing at the owner's expense.

Pets (Paragraph 23)
Residents may have pets only if they are kept or maintained in such a manner as not to create a nuisance. All residents should control their pets properly, which means confining them to their own property unless on leashes.

Recreation Vehicles and Personal Property (Paragraph 9 & 25)
No recreational vehicles, boats or trailers shall be stored on any lot in such manner that they would be visible from the street or lake. No motorcycles, three-wheelers, four-wheelers, all-terrain vehicles or the like shall be allowed to operate within the Shiloh Falls Subdivision. Golf carts operated by persons eighteen years or older are permitted.

Refuse and/or Trash Removal
Garbage is collected from all Shiloh Falls residences on Monday and Friday mornings. Garbage should be placed street side for pickup.
Residents are requested to place household garbage in garbage cans with tops to prevent animals from getting to it. Leaves and similar trash will be taken if placed in plastic trash bags alongside the trashcans.

Satellite Dishes, TV or Radio Antennas and Flagpoles (Paragraph 16)
Satellite dishes, television or radio antennas and flagpoles shall not be installed without the prior written approval of the Architectural Committee. Temporary flag pole staffs that do not exceed six (6) feet in length and are attached to the front wall or column of the dwelling do not require prior approval.

Signs (Paragraph 13)
No signs, billboards, or other postings may be erected without the written permission of the Architectural Committee. Yard signs (political, remodeling, roofing, landscaping, etc.) are prohibited.

Solicitation (Paragraph 21)
No solicitation or posters are allowed in Shiloh Falls at any time, including, but not limited to, fliers or notices placed in mailboxes or on homes, on car windshields, etc.

Speed Limits (Paragraph 10)
All roads and streets within Shiloh Falls, beginning with Old South Road at the intersection of Highway 57, are private roads and streets. All residents, property owners and their guests must obey the 30 MPH speed limit.
Very appropriately, concern focuses on the safety of children who may be in the street, pets who stray from the yard and for golf carts entering the roads from cart paths.
All residents, property owners and their guests, including service contractors, should remember to drive below the speed limit. Failure to do so may result in restrictions on bringing their vehicles into Shiloh Falls or other legal options.

Vehicle Registration for SFHA Windshield Decals
Residents & Property Owners should complete the SFHA Membership Registration Form (available from Security) to request SFHA Windshield Decals for each automobile used in Shiloh Falls. Security will issue Decals, but they will not be provided to family members/friends "not living at home" and Decals should be removed if property in Shiloh Falls is sold.
